DotMed applicant survives UDRP attack on its .med brand domain names

Panel sees through seemingly spurious claims by medical equipment seller.

.Med applicant HEXAP SAS has staved off an attack on its promotional web sites aboutdotmed.com, supportdotmed.com and thedotmed.com in a UDRP.

The company behind medical supplies company DotMed.com filed the complaint in June. DotMed.com has nothing to do with top level domain names, but it has applied for a trademark for “dotmed” as a top level domain.

It has also been battling trademark attempts by .med applicants, specifically HEXAP.

Its UDRP complaint was ambitious at best. It claimed that HEXAP wasn’t making a bona fide use of the domains and was offering services competitive and/or related to DotMed.com. This seems like quite a stretch, to put it mildly. DotMed.com also tried to characterize HEXAP as a cybersquatter, saying it has registered 120 domain names, most of which are “warehoused”. HEXAP is a web hosting company and had registered the domains for web sites.

The panelist found that HEXAP has rights or legitimate interests in the domain names. Unfortunately, panelist Christopher J. Pibus copped out on considering reverse domain name hijacking despite HEXAP asking for it.

Complaint filed against a .med backer.

Here’s an interesting UDRP case that attacks an applicant for the .med top domain name.

The domains in this dispute are aboutdotmed.com, supportdotmed.com, and thedotmed.com.

The complaint was filed by DotMed.com, Inc. I wrote about DotMed.com back in January when I revealed 115 trademark applications for potential top level domains.

The respondent is HEXAP, which is working with AFNIC to secure the .med domain name.

What makes DotMed.com interesting is that it’s an actual store for medical supplies that has been around for over a decade. But recently it decided to file trademarks for .med for use as a top level domain. This is a very different use than an online medical store.

World Intellectual Property Forum is hearing the case. It should find in favor the respondents, as DotMed.com can’t possibly have any existing trademark rights for the use in which the respondents are using e the domains. Clearly, the respondents have rights or legitimate interests in the domain names.
